Terms of Service
Version 1.0 · Effective [EFFECTIVE DATE]
These Terms govern your firm's use of LonestarPro Docket. Please read section 6 (what the data is and is not) and section 7 (your professional obligations) carefully — they describe limits on the application that directly affect how you may use it.
By ticking "I agree to the terms of service and privacy policy" during registration, you accept these Terms on behalf of your firm and confirm you are authorised to bind it. We record the date and time of that acceptance.
1. Who this agreement is between
"We", "us" and "LonestarPro" mean IONIC DATA LABS LLC, an Ohio limited liability company with its principal place of business at 6545 MARKET AVE N STE 100, CANTON, OH 44721.
"You", "your" and "the Firm" mean the law firm or other organisation that registered for an account, and every user who accesses the application under that account.
"The application" means LonestarPro Docket, a product of IONIC DATA LABS LLC — the software that sorts and filters Ohio crash reports and prints mailing labels and documents from them — and the documents it generates. The reports themselves are public records, available from public sources. Your subscription pays for the software and how it organises them, not for the reports.
2. Eligibility and approval
Access to the application is granted by approval, not by self-registration. You may request access through our public request form. We review every request and may approve or decline it at our discretion, without stating a reason.
Requests, registrations, and invited users must use an email address on your Firm's own domain. Addresses from free email services (such as Gmail, Yahoo, Outlook.com, or iCloud) are not accepted. Every user's email address must be on the same domain as the Firm owner's.
An approved request produces a single-use registration link that expires. You may not share it. Registration creates your Firm's account and makes the person who completes it the Firm's owner.
We may withdraw approval and suspend or terminate access at any time under section 12.
3. Accounts, users, and security
The Firm's owner and admins may invite additional users. Your Firm is entitled to the number of users its plan comes with, counting everyone who can sign in. If you need more, we offer additional users at the price shown when you add them, billed with your subscription for the same period. Adding a user is charged from the day they join, prorated for the rest of the current period. Deactivating a user ends their charge from your next renewal; no credit is given for the rest of the period. Invitations that have not been accepted are not charged. The billing page shows how many users you have and what they cost.
You are responsible for:
- everything done under your account, by any user you have invited;
- keeping credentials confidential and not sharing logins between people;
- removing users promptly when they leave your Firm; and
- telling us without delay if you believe an account has been compromised.
Each user must be a member or employee of the Firm, or a contractor working under its supervision and bound by equivalent obligations. Accounts are personal — you may not create an account for, or share access with, another firm.
4. Plans and Packages
The application is sold as a county package billed over a period.
- Statewide covers all 88 Ohio counties.
- Regional plans (Northeast, Central, Northwest, Southwest, Southeast) cover the counties listed for that region on our pricing page at the time you subscribe.
Available billing periods are monthly, quarterly, semi-annually, and yearly.
What you see is determined by your counties. Crash reports outside your entitled counties are not visible to you and are not included in anything you export.
Changes to a region do not change what you already pay for. Your county entitlement is recorded against your Firm when your subscription starts and when it renews. If we later add or remove counties from a region's definition, your existing entitlement is unaffected until your subscription next renews. We will tell you in advance if a renewal would reduce the counties you receive.
You may change the plan or period at any time from the billing page. Changes take effect as described at the point of change, and any proration is handled by our payment processor.
5. Trial, fees, billing, and cancellation
Trial. New Firms receive a free trial of 7 days. A valid payment card is required to start it. If you do not cancel before the trial ends, the subscription begins automatically and the first charge is taken.
Fees. Current prices are shown on our pricing page and on the registration form before you confirm. All prices are in US dollars.
Billing. Subscriptions renew automatically at the end of each period until canceled. We charge the card on file on each renewal date. Stripe processes payments; we do not store your full card number. You authorize us to charge the card you provide for all fees as they fall due.
Price changes. Except as set out under "Founding pricing" below, we may change prices. A change will not affect your current period, and we will give you at least 30 days' notice before it applies to a renewal.
Founding pricing. If your Firm subscribed under our founding offer, the rates you pay, for your plan and for each additional user, will not increase for as long as that subscription remains active. If you change plan or billing period, you pay the founding rate for the new plan or period as it stands on the date of the change, and that rate is then fixed in the same way. The founding rate ends if the subscription is cancelled, ends for non-payment, or is terminated under section 12, and it does not return if your Firm subscribes again.
Price match. During its trial, or before it first subscribes, your Firm may ask us to match the price it pays another crash report service by sending a recent invoice from that service, dated within the last 30 days. If we approve the request, you receive our Statewide plan at a discount set from the monthly amount your Firm was paying, as shown on that invoice and as we verified it. Specifically:
- The discount is a fixed percentage off our Statewide price. We work it out once, against our monthly Statewide price on the date we approve your request, so that you pay the monthly amount we verified.
- It never takes your price below 60% of our Statewide price for your billing period. If you were paying less than that, you pay 60% of our Statewide price.
- It lasts for the first 12 months of your subscription and then ends automatically. From then on you pay our then-current Statewide price or, if your Firm subscribed while our founding offer was open, the founding rate described above.
- It applies to whichever billing period you choose, in addition to any saving for paying in advance, and carries over if you change billing period during those 12 months.
- It applies only to the Statewide plan, and only while your Firm is on it. Additional users are charged at our normal rate.
- It cannot be combined with the founding offer or any other discount.
- It ends if the subscription is cancelled, ends for non-payment, or is terminated under section 12, and it does not return if your Firm subscribes again.
- We apply it for you when your Firm subscribes to the Statewide plan, or straight away if it already has. It can be applied once, within 30 days of approval.
Failed payments. If a payment fails, we may retry it and may suspend access until the balance is settled.
Cancellation. You may cancel at any time from the billing portal. Cancellation stops the next renewal; access continues to the end of the period you have already paid for.
Refunds. Fees are non-refundable except where required by law or where we cancel your subscription other than for a breach by you, in which case we will refund the unused portion of the current period on a pro-rata basis.
6. What the data is, and what it is not
This section matters more than any other. Read it.
Source. The reports in the application are crash reports filed by law enforcement agencies in Ohio. They are public records obtained from public sources. The application enables you to organize them according to your own requirements. We do not sell the reports; anyone may obtain them from those same sources.
We do not verify anything. We do not investigate accidents, contact the people named in a report, confirm an injury, or correct a report's contents. What you see is what the reporting agency recorded.
The priority score is an estimate. It is a way of ordering reports for your attention, not legal advice, not a valuation of any claim, and not a prediction of any outcome.
Accordingly, the data may be wrong. Names may be misspelled. Addresses may be out of date, incomplete or undeliverable. Injury severity, fault, insurance details, and vehicle information may be recorded incorrectly by the reporting agency or may be missing. Occupants may be omitted from a report entirely. A report may be amended by the agency after we have received it, and we may not receive the amendment.
Timing is not guaranteed. Reports appear when the reporting agency files them, and our collection processes receive them. We do not control either, and we do not promise that any particular accident will appear, that it will appear within any period, or that it will appear at all.
The application is not legal advice and is not a substitute for your own investigation or client intake. Any decision you make about a potential client, a claim, or a matter is yours alone, and you are responsible for verifying information before you rely on it.
Minors. Reports include occupants under 18. Where mailing documents are generated for a household containing a minor, correspondence is addressed to the parents or guardians. You remain responsible for whether and how you contact a household that includes a minor.
7. Your professional and legal obligations
You are solely responsible for complying with every law and professional rule that applies to how you use the data, including but not limited to:
- the Ohio Rules of Professional Conduct, and the rules of every jurisdiction in which you are admitted or practise, as they apply to advertising and to solicitation of prospective clients;
- any waiting period or other restrictions on written communication with accident victims or their families
- any labeling, disclosure, or record-keeping requirement applicable to targeted written solicitation;
- federal and state restrictions on telephone, text, and fax contact, if you use the telephone numbers in the data for those purposes; and
- all applicable privacy, data protection, and data security law.
The application does not enforce any of these for you. It does not impose a waiting period between the date of an accident and the date you may generate a mail piece, it does not add required disclosures to the documents it produces, and it does not check the contents of anything you send. Date filtering and the selection of recipients are controls you operate yourself. You must satisfy yourself that any mailing you produce is permitted at the time you send it.
Letter templates. You write and design your letter templates, whether you upload them or create them in the application. The application fills in only the fields it makes available for that purpose — such as the recipient's name and address and the crash date — and changes nothing else in your template. It does not review, approve, correct, or add to the contents of any letter, including any label, disclosure, statement, or enclosure that a law or professional rule requires you to include. The contents of every letter, and whether it may be sent, are your responsibility.
Checking what you send. Before anything is mailed, you must check that each letter, label and report copy belong together, and is going to the right person at the right address. That responsibility is yours whatever the cause of a mismatch — an error in the report, in an address, in how a document was generated, or in how your office assembled the envelope. Match codes, where you use them, are an aid to that check, not a substitute for it. We are not responsible for a communication that reaches the wrong person or carries the wrong report.
Recipient requests. If a person asks you not to contact them, you are responsible for honoring that request. The application does not keep a do-not-contact list, does not record such requests on your behalf, and will not leave anyone out of a mailing run on its own. You must keep your own record of those requests and make sure that no mailing you produce reaches a person who has asked not to be contacted. Our Privacy Policy tells people who do not want to be contacted to tell the firm that wrote to them, so those requests come to you, not to us.
8. Permitted use
Subject to these Terms and to your account remaining in good standing, we grant your Firm a non-exclusive, non-transferable, revocable right to access the application and to use its functionality for your Firm's own internal business purposes, including identifying and contacting prospective clients and servicing your matters.
You may not:
- resell, sublicense, republish, syndicate, or otherwise make the data available to any third party, including another law firm, a lead generator, a marketing agency, or a data broker;
- use the application on behalf of, or for the benefit of, any firm other than your own;
- extract the corpus in bulk, or use any automated means to scrape, crawl or copy the application beyond the export features provided;
- reverse engineer the application, or attempt to access data for counties you are not entitled to;
- use the data for any purpose prohibited by law, including discrimination, harassment, stalking, or any consumer report purpose regulated by the Fair Credit Reporting Act; or
- remove or obscure any notice or marking applied to a document the application generates.
Your own service providers. You may allow a print vendor, mailing house, or similar contractor to handle documents you have exported, strictly to send the mailing on your behalf, provided they are bound to confidentiality and to use the data for no other purpose. You remain responsible for what they do with it.
9. Documents you have already downloaded
Documents you export — labels, merged report PDFs, and mail packs — are yours to keep. If your subscription ends, we do not and cannot recall files you have already downloaded, and nothing in these Terms requires you to destroy a mailing you have already produced or sent.
Your obligations in sections 7 and 8 continue to apply to those files after your plan ends, including the restriction on transferring the data to anyone else.
Your access to the application, and to any export still held in your account, ends when your plan ends.
10. Our rights
The application, its interfaces, filters, and packaging we apply to the data are ours or our licensors', and are protected by intellectual property law.
We do not claim ownership over the underlying public records themselves or over the facts they contain.
You own the content you put into the application — your account details, saved filters, mailing lists, and the selections you make. You grant us the right to host and process that content as needed.
Feedback. If you send us suggestions, we may use them without obligation to you.
11. Privacy and security
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
Letter templates, letterheads and enclosures you upload or create are stored privately for your firm, are available only to your firm's users, and are used only to produce your letters.
Tell us promptly if you become aware of unauthorized access to your account or of data being disclosed outside your Firm.
12. Suspension and termination
We may suspend or terminate access — immediately and without refund where the breach is material — if:
- fees are unpaid;
- you breach section 7 or section 8;
- we reasonably believe the account is being used to obtain data for a firm or person other than yours;
- we reasonably believe continued access creates a legal risk to us or a risk to the people named in the data; or
- you are no longer eligible under section 2.
Where the circumstances allow, we will tell you what the problem is and give you a chance to fix it before we suspend.
You may terminate at any time by cancelling under section 5.
On termination, your right to access the application ends. Sections 6, 7, 8, 9, 10, 13, 14, 15, and 17 survive.
We may discontinue the application on 30 days' notice, in which case we will refund the unused portion of any period you have paid for.
13. Disclaimers
The application is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
Without limiting that, we do not warrant that the application will be uninterrupted, timely, secure or error-free; that the data will be accurate, complete, current, or fit for your purposes; that any particular accident report will be available; or that using the application will produce any particular commercial result.
We offer no service level commitment. The application depends on third parties we do not control, including the agencies that file reports and the providers that host the application.
14. Limitation of liability
To the fullest extent permitted by law:
Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, or lost goodwill, however caused and on any theory of liability, even if advised such damages were possible.
Our total aggregate liability arising out of or relating to these Terms or the application, for all claims combined, will not exceed the total fees you paid us in the 30 days immediately before the event giving rise to the claim.
These limits do not apply to liability that cannot be limited by law.
Nothing we provide is legal advice, and we have no liability for any professional consequence of your use of the data — including any disciplinary action, sanction, claim, or loss arising from how, when, or to whom you send a communication generated from the application. That responsibility is yours under section 7.
15. Indemnity
You will indemnify, defend, and hold us harmless from any claim, demand, proceeding, loss, liability, damage, fine, penalty, cost, and expense (including reasonable legal fees) arising out of or relating to:
- your use of the application or of any data or document obtained through it;
- any communication you send to any person identified through the application;
- your breach of these Terms, in particular sections 7 and 8;
- your violation of any law or professional rule; or
- any act or omission of a user acting under your account.
We will notify you of any claim, and you will not settle any claim in a way that imposes an obligation on us without our written consent.
16. Changes to these Terms
We may update these Terms. If a change is material we will give you reasonable notice — by email to the Firm's owner, or in the application — before it takes effect.
Changes apply from their effective date. If you do not accept a change, your remedy is to cancel under section 5 before it takes effect. Continuing to use the application after that date means you accept the updated Terms.
We keep a record of the version each Firm accepted and when.
17. General
Governing law. These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws rules.
Venue. Except as set out under "Injunctive relief" below, the state courts located in Stark County, Ohio, and the United States District Court for the Northern District of Ohio, have exclusive jurisdiction, and both parties consent to that venue.
Informal resolution first. Before starting a proceeding, a party must send the other written notice describing the claim, and both must try in good faith to resolve it for 30 days. This does not apply to a request for injunctive relief.
Injunctive relief. We may seek an injunction or other equitable relief in any court of competent jurisdiction to stop or prevent a breach of section 8 or section 11, without posting a bond where the law allows.
Jury trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
No class or representative actions. To the fullest extent permitted by law, each party may bring claims against the other only individually, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
Time limit for claims. Any claim against us arising out of or relating to these Terms or the application must be brought within one year after it arose, or it is permanently barred.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the application, and replace any prior understanding.
Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent needed to make it enforceable.
No waiver. A failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our written consent, except to a successor to your practice that assumes them in full. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for a failure to perform caused by events beyond its reasonable control.
Notices. We will send notices to the email address on the Firm's owner account. You should send notices to contact@lonestarpro.app.
Relationship. Nothing here creates a partnership, joint venture, employment or agency relationship, and no attorney-client relationship exists between us.
